What a fence quote in East Maitland needs
- The length in metres and the height, and which boundary the fence is on
- What's there now, and whether the old fence comes out first (more than 10 m² of fibro must be removed by a licensed asbestos removalist)
- Whether a neighbour shares the boundary: under the Dividing Fences Act they usually share the cost, after a fencing notice
- The ground: slope, rock, tree roots, and access for posts and materials
- Photos of the fence line and anything in the way
Front fences in the East Maitland heritage conservation area
East Maitland is one of the seven heritage conservation areas in the Maitland LEP 2011, and by our count of the LEP's heritage schedule it has more listed heritage items than any other suburb. That changes the fence rules. In the conservation area a front fence, or any fence along a road, isn't exempt development, so it needs approval; and on a heritage item's lot, or along its shared boundary with a neighbour, no fence is exempt.
For those fences, the Maitland DCP 2026 asks for front fences "no higher than 1.2m", open rather than solid, in a style that suits the house: timber pickets, low masonry or hedges. Side fences forward of the building line are to be "timber paling fences using steel posts in concrete footings", and clip-lock or painted steel fences aren't supported on street frontages. Removing an old fence in the conservation area isn't exempt demolition either, so ask council first.
Back and side fences behind the house
A side or rear fence behind the building line, up to 1.8 m, can still be exempt development in the conservation area, as long as neither your lot nor your neighbour's is a heritage item and the lot isn't a flood control lot. Most of the newer streets in Ashtonfield, Metford and Tenambit fall under the ordinary NSW rules.
Old fibro fences and the Mount Vincent Road tip
If an old fibro fence is coming down, the Maitland Resource Recovery Facility at 109 Mount Vincent Road, East Maitland, takes wrapped asbestos on Wednesdays and Fridays only, booked with the weighbridge ahead of delivery (council guide). More than 10 m² of fibro must be removed by a licensed asbestos removalist. See fibro fences and asbestos.
Council's draft flood study update has a drop-in session at Stockade Hill on 13 November 2026; flood mapping decides whether a fence needs approval (flood management planning).
